2. Description of Service

BookingBuddy is a booking management platform that allows businesses to manage appointments, bookings, and customer interactions. The Service includes web-based software, mobile applications, and related services provided by BookingBuddy.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Subscription and Payment

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. All fees are non-refundable except as required by law or as otherwise stated in these Terms.

5.3 Price Changes

We reserve the right to change our pricing at any time. We will provide you with at least 30 days' notice of any price changes. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

The Service and its original content, features, and functionality are owned by BookingBuddy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You represent and warrant that you have all necessary rights to grant this license and that Your Content does not violate any third-party rights.

  • Payment Processing: Payment information is processed and stored by Stripe, our payment processor, which is PCI-DSS compliant and uses end-to-end encryption for all payment data.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKINGBUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BookingBuddy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in the Service.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in any fraudulent, illegal, or harmful activity.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, subject to our data retention policies and legal obligations. All provisions of these Terms that by their nature should survive termination shall survive.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, except where prohibited by law.

You agree to waive any right to a jury trial and to participate in a class-action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BookingBuddy operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookingBuddy regarding the Service and supersede all prior agreements and understandings.
